I'm told that even though he's been accepted as needing hospital he's not actually classed as sectioned until he gets to the secure unit and this is what the biggest problem. Does your solicitor have experience of the Mental Health Act and it's implementation? I don't think it's legal to section a person but not provide them with treatment. Thanks for the extra info but I still don't understand why he can't be sectioned. If he has a mental illness, is a danger to himself or others and is treatable, then surely he meets the criteria for the Mental Health Act?
